General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to the nursing services offered by WundPal Wundmanagement & Palliativpflege e.U., unless expressly agreed otherwise.

They govern the basis of the cooperation between WundPal and the clients, their legal representative or an authorised person.

By commissioning the services and being given the opportunity to review these General Terms and Conditions, they are deemed to have been agreed.

2. Scope of Services

WundPal provides nursing services in the areas of wound management, palliative care and nursing consultation within the framework of the applicable statutory provisions.

The specific scope of services is determined by the individual agreement with the clients and the nursing requirements of the individual care situation.

The range of services may in particular include:

• professional wound management
• palliative care and support
• nursing consultation and family caregiver consultation
• assessment and documentation of the health status
• coordination with physicians and other healthcare professionals
• support with organisational matters related to care
• professional wound documentation and progress monitoring

The nursing services provided by WundPal are delivered in accordance with the applicable statutory provisions, professional regulations, and the current state of nursing science.

The type, scope and frequency of care are determined by the individual needs of the clients, the professional nursing requirements and the services jointly agreed.

3. Conclusion of the Contract

The cooperation between WundPal and the clients begins with the commissioning of the agreed services. The care agreement may be concluded in writing or in another legally permissible form. be concluded.

If a client is unable to effectively conclude the contract themselves, the contract shall be concluded by the legal representative or an authorised person. WundPal is entitled to request appropriate proof of the authority to represent the client.

Even where there is a legal representative, WundPal places particular importance on involving the person concerned in decisions wherever possible and taking their wishes and needs into account.

There is no entitlement to conclude a care agreement. WundPal reserves the right to refuse care if legal, professional or organisational reasons prevent proper provision of the services.

4. Appointments and Home Visits

Home visits are carried out exclusively by prior appointment. The agreed appointments serve to ensure reliable planning and continuous care of the clients.

Appointments may also be arranged or cancelled by legal representatives, authorised persons, relatives, or other persons authorised by the client. The same provisions of these Terms and Conditions apply to appointments arranged or cancelled by such persons.

If an agreed appointment cannot be kept, clients are asked to cancel as early as possible.

An appointment may be cancelled free of charge up to 24 hours before the agreed appointment.

If an appointment is cancelled at shorter notice or an agreed appointment is missed without prior notice, a personal reminder will be given for the first occurrence. WundPal places great importance on a trusting and respectful cooperation.

If there is another short-notice cancellation or an unexcused no-show, WundPal is entitled to charge a cancellation fee amounting to 50 % of the agreed fee.

Successful care requires a trusting cooperation between WundPal and the clients.

Clients undertake to provide all information relevant to their care completely and to the best of their knowledge. Changes in their health status and other circumstances that may be relevant to nursing care must be communicated to WundPal promptly.

The aim of care is to work together with the clients to create the best possible conditions for improving the health status, alleviating symptoms or maintaining or improving quality of life.

The specific treatment assignment is based on the individual situation of the clients. While wound management often focuses on promoting wound healing, palliative care may prioritise symptom relief, odour control, pain reduction or maintaining quality of life as the primary treatment objectives.

The treatment outcome depends on numerous medical, nursing and personal factors and therefore nicht garantiert be concluded.

WundPal is obliged to provide professionally appropriate nursing care, but not a specific treatment outcome or complete healing.

7. Cooperation with Other Healthcare Professionals

Optimal care often requires close cooperation with other healthcare professionals involved in the care.

Where necessary for care and where the clients’ consent or a legal basis exists, WundPal works with treating physicians, hospitals, care facilities, therapists and other health and social care professionals.

The aim of this cooperation is coordinated, safe and needs-based care for the benefit of the clients.

8. Documentation

To the extent required by law, WundPal maintains professional nursing documentation of the services provided.

This may include, in particular, observations, nursing measures, consultations, wound documentation including wound photographs, progress monitoring and other information relevant to the care provided.

The documentation serves quality assurance, traceability of care, compliance with statutory documentation obligations and safe cooperation with other healthcare professionals involved in the care.

Personal data is processed exclusively in accordance with applicable data protection regulations. Further information is provided in WundPal’s Privacy Policy.

9. Fees and Payment Terms

The current fees and prices of WundPal apply to the services provided. WundPal reserves the right to adjust its fees and prices for future services. Price changes will be communicated to clients before they take effect and shall apply to existing service agreements from the date communicated.

The agreed fees and prices shall, unless otherwise stated, be understood as final prices. No VAT is charged on nursing services in accordance with the applicable statutory provisions. For goods and other services, the applicable statutory VAT provisions shall apply.

The fee is generally payable immediately after the service has been provided. If this is not possible in an individual case, payment may be made by bank transfer or by invoice.

At the clients’ request, WundPal is happy to assist with preparing documents for possible submission to health insurance or social insurance providers.

The decision on the type and amount of cost coverage or reimbursement lies exclusively with the respective insurance provider. Entitlement to reimbursement therefore nicht garantiert be concluded.

If an invoice remains unpaid after its due date, WundPal is entitled to claim statutory default interest and necessary costs of out-of-court and court enforcement in accordance with the applicable statutory provisions.

10. Liability

WundPal’s liability is governed by the applicable statutory provisions.

WundPal assumes no liability for disadvantages or damages caused in particular by incomplete or incorrect information, lack of or insufficient cooperation, failure to follow nursing or medical recommendations, or by circumstances beyond WundPal’s control.

No guarantee of a specific treatment outcome or complete healing is provided.

WundPal has professional liability insurance coverage.

11. Availability

WundPal endeavours to be reliably available during regular business hours.

Continuous or immediate availability cannot, however, gewährleistet be concluded.

In medical emergencies, immediately contact the emergency number 144 or the appropriate emergency medical service without delay.

12. Final Provisions

If individual provisions of these General Terms and Conditions are or become wholly or partly invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The invalid or unenforceable provision shall be replaced by a legally permissible provision that comes closest to the purpose of the invalid or unenforceable provision.

Austrian law shall apply, excluding conflict-of-law rules. Mandatory statutory consumer protection provisions remain unaffected.
